Yeah, but swept away when UKIO took a security of £6.8m over it in (?) December.
So essentially if Hearts are to avoid liquidation they have to find £6.8 million in the next 10 days - before UKIO's liquidators start coming for their recoverable assets?

It is still possible that hearts could gamble to be in a mathematically uncatchable position (ie relegation impossible) then stuck themselves in admin

They are planning a strongly worded letter, hopefully in time for next Sundays Sunday Post, and this is only the beginning, by August (holidays allowing) there will be another letter to Dave Cameron telling him who they are and how unfair it all is and he better do something about it because they won a war.
By August or maybe September if their wives agree, the activists numbers will have risen from the original hard core of 4 to as many as 7 and they will have moved from the golf club snug to protesting outside the parliament building, so long as they get back from Asda in time. Even as we speak they are looking at material samples so they can have matching yellow shirts and some casual slacks knocked up so as to make the right impression. The pressure is mounting, can you hear them mobilising? :trumpet:

They are planning a strongly worded letter, hopefully in time for next Sundays Sunday Post, and this is only the beginning, by August (holidays allowing) there will be another letter to Dave Cameron telling him who they are and how unfair it all is and he better do something about it because they won a war.
By August or maybe September if their wives agree, the activists numbers will have risen from the original hard core of 4 to as many as 7 and they will have moved from the golf club snug to protesting outside the parliament building, so long as they get back from Asda in time. Even as we speak they are looking at material samples so they can have matching yellow shirts and some casual slacks knocked up so as to make the right impression. Even john robertson admitted that administration is almost inevitable.The truth is nobody knows what will happen and they wont go into admin for at least ten days with the bankruptcy appeal timescale.They will probably make it to the end of the season but with a deBt repayment of over £1m to pay next year plus another £.5m to the taxman means they start the season minus £1.5m before they start paying the players etc.Even the most fervent hertz fan can see that they are royally screwed and can only hope they somehow come out of it in the spl and playing at the pbs. Most likely they will go into administration on june the 2nd and start next season minus 12 points
The fact that they are so deluded on sickbag that they cant see this will make all the funnier when it does happen.A most enjoyable soap opera with im sure a very happy ending(for hibs fans that is)

I wouldnt be surprised if Hearts get out of this pretty much scot free. It seems that the liquidators of UKIO will take a while to get moving, and will - as is usually the case in these matters be forced to accept much less than the full debt. Politics aside, how do they expect to recoup £15million?
Ill predict that:
1. Hearts will not get relegated
2. Might start the next season with a 12 pt penalty for possibly going into administration at the end of the season (which by the way is a hideously paltry penalty for 10+ years of massive over spending).
3. Jambos in your neighbourhood will start gloating about their great escape

Why would Lithuania care a jot about Hearts and why would this affect their relationship with the British government? I'm pretty sure David Cameron and co. really don't care a jot about a debt-ridden football club in Edinburgh. Hearts fans and sympathisers have got addled brains through years of delusion. Time to face the facts and pull your head out of the sand - nobody in Lithuania cares, nobody at Westminster cares and most of Scotland doesn't want you to squirm off the hook.

The Lithuanians could accept paying the debt on an interest only basis for two years, but that leaves them in the same (or possibly worse) position after the two years. They could find a buyer in the short term with an acceptable offer, which is very unlikely (too complex and expensive). Or they could go into administration.
The long and short of it is that they are hoping the thing drags out long enough that the points penalty applies next season rather than this.

Hearts could do an administration in the summer, ditch a few more contracts, weadle some loan deals, and attract the kind of braindead roasters that Rangers did, and come out the traps with a cause to rally round.
Hearts are on a shoogly peg, but they are very very far from 'dead'. It seems that we keep preparing for a party that isnt going to happen. And the annoying element of their support will grow even stronger as a result.

Why would the Lithuanians take a few million when they could just sit on the debt for years and let them ***** every possible spare penny on paying them the full amount back.
Also, why would any potential owner pay a few million and suffer years of paying back the criminal debts of the previous owners when they could pick up the same club after their bust for pennies and start again. That also applies to the HMRC debt. £1.5m for absolutely nothing.
There seems to be a lot of logical leaps being made by the more simple and optimistic element of the hearts support. They are dead - they are just trying to save face while they splutter their last toxic breath.

I am all for beating them on the pitch especially when they spend the same amount of money as we do not 3 times it.
Administration is not just a few penalty points and all is Barry. They would need to come out of admin and evening they did and convinced creditor to accept pence in pound, nobody would touch them with credit, all players could walk, they would most lose the pink bus shelter and they would need a fair amount of capital to get going again. This of course discounts the fact that season ticket money say 8000@ £300 = £2.4 would be lost and they would have to rely on supporters to make up the shortfall.
A summer administration would be a disaster for them and with a 14 point penalty at least and no Dundee late to the SPL scenario, they would be odds on for relegation and another administration on the cards say in a year or two.

In some ways, it's much better for Hearts to face the medicine right now, if possible, and take admin/relegation, lose the PBS, and play in a lower league. Even penniless and groundless, they at least have their fanbase.
If they do this, they might be able to disassociate themselves from the car cash of UKIOS/UBIG.
They do not want to be around this when criminal investigations into where the monies those companies (and therefore Hearts) have been funded with have come from. This could stop them playing in any league for some time, making it hard for them to retain a support.

This I wasnt aware of, so fair play. Other points have also been put forward to support the case that the Yams are up the creek. I do happily concede they are in a tricky spot, however I see a lot of escape routes for them.
My point is that any shaudenfreude over this situation for me is far better realised on the pitch.

Whilst it's true that the football stadium is only of any use to The HoMFC, by the same token The HoMFC needs the football stadium.
A exorbitant high rent (just enough to allow them to keep trading) would be a much better way to claw back a substantial amount of the debt than selling it "on the cheap" to some supporters group.
The ball would then be in the court of the football club to pay the required rent or move out, and if it were the latter .. leaving an empty stadium with a nice chunk of land ready to sell on the open market.
We all know (deep down) that Hearts aren't going to disappear, and the share issues simply proves to the Lith's that they have a large group of people willing to throw money at football team, and they could potentially use it to their advantage.

The administrator doesn't have to take the best offer if liquidating the company will raise more money than the offer to buy. Looking at some of his other tweets he seems to just make up any crap just to win an arguement, regardless of whether its true or not.

Sorry, but their share issue shows nothing of the sort. They only met half their target despite painting the potential scenario in very blunt terms. There's only so much money Hearts fans will have to keep giving the club and it seems they've already exhausted it

Also, I thought the stadium was collateral from UBIG to UKIO for 15 mil, and vlad used to the stadium as a bargaining tool to take the 15 mill out the bank..........fluck me im totally confused now like.

Good idea about squeezing the Yams but first you have got to collect the rent. Problems with that down at the Riocho Arena.
Secondly, who would pay to make the place habitable for next season ? In all today's excitement I forgot I was told yesterday the safety certificate for the PBS was not going to be re-newed without major alterations to the old stand. Can't vouch for the info. as it was second hand but not unexpected.

And the bit in bold hits the nail firmly on its head when it comes to discussing football with anyone of a Yam persuasion......it gets so frustrating when you realise they have no principled stance on anything.....they just agree with whatever they think is best for Hearts at that given point in time, even if they argued the exact opposite the day before. That's why it was so easy for Vlad to piss them about without question.....Muppets deserve to have their club die, quite frankly....

I disagree that they cant be sold. If in the grab for cash, some investment group comes in with 4-5million, to placate the lithuanian creditors and clear debts (HMRC etc etc), and then look to get their money back at say £250,000+ per year, then theyve got a steady earner with a possibility of a sale in future to recoup the rest of their investment (and a bit of profit).
I agree that its going to be very hard for Hearts to continue without some form of financial handicap, but they have a turnover of around at least 7 million (it was 7 million in 2003/4 and a lot more in 2008). They can soak up some form of repayment plan - to whomever - and still operate as a football club.
Id be delighted to see them go the way of Rangers, and would be just desserts, but I just dont buy into the certainty that some have.

My understanding was that they don't owe UKIO anything.
They owe UBIG an "undisclosed" amount (estimated to be anything between £25m-£40m).
UBIG at some point in the not too distant past used Tynecastle as a £15m security on loans from UKIO to UBIG.
Beyond that I have to admit that I am lost as to the implications of what is getting played out in Lithuania and how things directly affect Hearts ability to continue in their current form.
I kinda get the impression though, that if administration kicks in it is down to their own inability to pay their bills, rather than getting taken down by anything that is currently going on in Lithuania. :dunno:

The UKIO money isn't a loan, AFAIK. £15m has been mentioned, as has £10m. However, UKIO have a security over Tynie for £6.8m, which was taken out a few months ago. My understanding is that that is the amount owed to UKIO, either by them or UBIG. The £15m is probably the "facility", ie the maximum HMFC could go to on their overdraft.
The UBIG debt is secured by a charge over all of the assets. These, of course, are diddley-squat. How much is that debt? Pick a number..... but I wouldn't be surprised at £20m.
What today has cleared up is the confirmation of UKIO's administration. That means that their administrator will come for Tynie.
Other than that, you're right, not much has changed.... except that sphincters are moving much more quickly than they were yesterday.

Are you sure that statement is correct? Is it not VLADS assests that has been frozen? The shares are with UBIG, who, as far as I know are still a normal active trading company (for the moment any way) so one of 2 things could happen:
1) new board member(s) are appointed at UBIG who on vlads say so sell the shares to highest bidder or,
2) UKIO call in debt owed by UBIG in the not to distant future, and without explaining things for the millionth time ripples through to hearts being put in admin should UBIB be unable to pay said debt.

That is the main argument against the Lithuanian Administration People (hope we get to hear who they are soon so we can start calling them by their names, lovely guys btw) renting that tip back to the club and hoping to see cash back before eventually offloading onto, say FoH. As owners they would be responsible for the upkeep of said khasi - they would have to deal with the safety aspect and safety upkeep, the asbestos management complete with regular health and safety inspections, the Council tax complete with arrears etc etc.
They would be doing Hearts a huuuuuuge favour by agreeing to taking that lot on.
A further aspect is that Hearts, along with paying the rent would also be expected to service the debt (which seems to be split between both UBIG and UB(r.i.p.). No this is heresay but I've heard from several sources that Hearts have never once paid any interest on the debts accrued during Mr Romanov's tenure, he merely added onto the debt thereby increasing said debt and ironically making the interest higher. There's no doubt that if the nice Lithuanian Administration People :not worth were kindly enough to allow that rape clan to continue living in their lean-to at a set rent they would also want their pound of flesh re the set interest payments.
Add in the HMRC debt and the normal running costs of just merely being a Football Club they just wouldn't be able to cut.
No way are the going to bend over for HMFC like that - admin, liquidised, sell off the **** that isn't nailed down and some that is - HMFC kaput.

Are you sure that statement is correct? Is it not VLADS assests that has been frozen? The shares are with UBIG, who, as far as I know are still a normal active trading company (for the moment any way) so one of 2 things could happen:
1) new board member(s) are appointed at UBIG who on vlads say so sell the shares to highest bidder or,
2) UKIO call in debt owed by UBIG in the not to distant future, and without explaining things for the millionth time ripples through to hearts being put in admin should UBIB be unable to pay said debt.

The UKIO money isn't a loan, AFAIK. £15m has been mentioned, as has £10m. However, UKIO have a security over Tynie for £6.8m, which was taken out a few months ago. My understanding is that that is the amount owed to UKIO, either by them or UBIG. The £15m is probably the "facility", ie the maximum HMFC could go to on their overdraft.
The UBIG debt is secured by a charge over all of the assets. These, of course, are diddley-squat. How much is that debt? Pick a number..... but I wouldn't be surprised at £20m.
What today has cleared up is the confirmation of UKIO's administration. That means that their administrator will come for Tynie.
Other than that, you're right, not much has changed.... except that sphincters are moving much more quickly than they were yesterday.
This would confirm my suspicions, no way is there debt at 25 million, I reckon it sits about 32 million but the known loans etc are what is being discussed in the press as though that's all there debt. There were nine bids put in for the Tynecastle site and the highest came from the Stewart Milne Group who had bid (pounds) 24m but the Hearts board felt the Cala bid was ''the best all-round offer'' on the table.
No shortage of bidders for "hallowed ground" back then. Honestly you'd think it was a Cherokee Burial Site and everyone had to take their horses over the mountains and through the pass in order to avoid their wrath. It's a few acres of mediocre real-estate in a grubby, industrial/post-industrial area of town. A few miles further North or South and it be worth triple but it ain't, most business minded people will see it as another land commodity to be invested in or not depending on what they can make from it or what that can do with it.
Unless Salmond/The National Trust tip up and turn into a National Park or Weirdo Sanctuary or something.

It's more likely that the SPL board will play it by the book, because they will not want Hearts out of the league unless it is forced upon them. Losing the Edinburgh derby on top of no Rangers = not good for ratings.

There's nothing HMRC can do about it. They are owed the second and third lots of £500,000, but those aren't due for payment until next year and the year after. HMFC are up to date with their normal payments, according to McLauchlin in the podcast linked above. If they weren't, there would already be a petition in the court.

There's nothing HMRC can do about it. They are owed the second and third lots of £500,000, but those aren't due for payment until six months and 12 months from now respectively. HMFC are up to date with their normal payments, according to McLauchlin in the podcast linked above. If they weren't, there would already be a petition in the court.
I reckon they could, although it would be nasty of them to do it.
The remaining £1m was due the day the assessments were raised. HMRC have given them time to pay it, that is all. They could go by the letter of the law and demand immediate payment.
That said, I don't think that they will. They have played Hearts well thus far, and their tactic of getting cash from ST sales has worked. They will be quite happy to let the agreement continue.
Edit:- I have just noticed that you say the next instalment is due in 6 months. I thought it was 3 annual payments.

Might be so they can go into admin on their terms (if that makes a difference?).
Missing the hmrc payment would have brought a winding up order against them which could have killed them off.

Ok - but did Sevco not manage to go into admin on their terms (and appoint their favoured Administrators) - despite HMRC attempting to force the issue, why would the Yams be any different - if the rumours are true they already have Administrators lined up so could do the deed before HMRC have time to act - maybe its just my lack of knowledge on these sort of financial issues.

Yip tats what my take on it would be. They know if they miss any payment to HMRC its straigt to winding up order. however I dont see what putting themselves in Admin would achieve? Admitadly im no expert but i belive to get out of admin they would need to aggree a CVA of a pence to the pound on all creditors which HMRC would reject. So would vaualantery admin even be worth it/an option

I think the hearts situ is pretty different in the fact they would not be able to sell/transfer the assests of the stadium or the shares at the moment.

That's the clearest sign yet that they're planning on going into administration as soon as possible after they're safe from relegation. That's got to raise a big red flag for HMRC and any business they're due money to.
I don't really get the "they'll wait till they're safe" argument.
Surely this would be dependent on creditors agreeing a CVA and as Ukio have security over all assets there is zero chance of this happening?
Liquidation and Division 3 will soon follow regardless of whether they avoid relegation?

Sevco got their own administrator but hmrc forced them into administration iirc.

Yeah the CVA would have to be agreed by the Lithuanian authorities as they are the main creditor with the bulk of the debt. It would make no sense for them to accept a 20p in the £1 deal as they will end up owning the stadium (which was valued at 6.8m as security on the 15m debt to Ukio). I think it will take someone to offer 6.8 million in order for the Liths to talk, if they dont they could eventually liquidate the company and sell the stadium anyway.

Sevco, or rather CW, I reckon already had a good relationship with Duff and Phelps due to previous business dealings and would have known that they would have been (to a certain extent) "sympathetic" to CW's requirements. For example, the sale of assets for £5.5m.
In not sure that anyone at Hearts will have anyone on board with the same type of relationship with an administrator that CW had with Duff and Phelps.

Not sure div 3 would automatically follow. If they don't have the PBS this could work against them.
Plus the Spartans and other sides would surely mount a challenge if teams like them and pars were shoe horned into div 3

No, the Liths would not be involved in a CVA as they are secured creditors.
I reckon that HMRC would be the main creditors in a CVA, although they're not known for accepting CVAs so the outcome would be the same .. rejected.

It's all about timing. If they had missed the £500K payment, then HMRC would have filed a winding up petition against HMFC immediately. That would have gone through within two weeks, meaning HMFC would have entered insolvency (in this case liquidation) before the end of the season.

I suspect HMFC will have consulted with their lawyers and I think they will take the club into a Voluntary Administration........
1) Does this buy them time/protection from being liquidated by Valnetas UAB the Lithuanian appointed administrator.
2) By going into Voluntary Admin gives them greater control on their own destiny.
3) They want to control the process rather than being pressured/dominated by Valnetas
Whatever outcome is, Liquidation is an inevitable consequence. FOH offer of say £2 million will be kicked into touch, there are many property developers/speculators that see more worth in *********** than that being offered by FOH

The rules are not as simple as that. Rule A6.12 talks about the penalty only applying after the Board has considered the integrity of the league, the reputation of the league and the relationship between the [parent company] and the [club]. The club can then also appeal on the grounds that the parent company insolvency is a force majeure event (ie out of their control).

The problem for the SPL is proving it.
We all know that without repayment plans and share issues (where are those shares BTW?) then they would not have managed to limp over the finishing line. However, the SPL would need hard proof that they were unable to trade within their projected turnover for them to force the issue, which I suspect they would not really want to do anyway.

Slightly off topic but my mate is a car salesman with Volkswagen on Gorgie Road. They store about 10 to 15 cars in the car park at the main stand at Tynecastle, something they have done for years with the club, they have some sort of agreement. Anyway they got told yesterday to have all the cars moved from the car park as soon as possible. Bit strange considering they have been there for about 4 years.

I am sure the overspending by HOMFC which in turn forced UBIG into approx. £ 50 million of bail outs in the way of debt for equity and forgiveness debt scams played a part in any insolvency process of Heart's parent company.
The problem will be getting the blazers and media to accept it. There are none as blind as those who don't want to see !

Two points on the bit you quoted.
Hearts are not self-sufficient. The amounts owed to UBIG were due for repayment by December 2011 HoMFC have been unable to make that repayment for over a year, therefore they can't pay their debts as they fall due, therefore they are insolvent.
'Mr Romanov' has often boasted about putting £60m into HoMFC since he bought them. That money has (or should have) contributed massively to the club's performance over those years and has also contributed to UBIG's downfall. No club in Scotland has benefitted more from having a parent company and no club is more deserving of the penalties for failure of their group.

BTW, some folk here have incorrectly stated that HMFC would be deducted a minimum of 15 points next season. That isn't correct.
Rule A6.8 states that the minimum deduction is 10 points. As HMFC already have more than 30 points this season, the deduction would be one third (rounded up) of their final total this season. As it stands that would be 14 (40/3 = 13.333).
