Judge however wants a full trial of King on a further matter, wants it held in January.

Discussion of other matters still to be dealt with. Judge keen to hear by end of January. Seeking clarification.

Two applications to be heard tomorrow at 10am. Not clear yet what they specifically refer to.

Lifted from Kerrydale Street, while they were discussing the character of the judge. :
Has anyone Googled 'Judge Peter Smith'?
Reprimands, rants, etc. Seems handpicked for a Dave King circus.

Quote:
A judge whose behaviour was adjudged by the Court of Appeal as “wholly inappropriate” when he took part in “extraordinary” exchanges in court, has received an official reprimand. Mr Justice Peter Smith was reported to the Office for Judicial Complaints after showing “undoubted animosity” towards a party in a case before him. The furore arose after a case involving Addleshaw Goddard came before him and he was asked to stand down since the law firm had previously rejected him for a job. The judge, however, refused. Sir Anthony Clarke, Master of the Rolls, and two other appeal judges in Howell & Others v Lees Millais & Others, ruled that Peter Smith J had got “carried away”, had shown “undoubted animosity” and was “intemperate” in the way he handled the application for him to stand down. The judge, the appeal court ruled, should have recused himself.

Seems as if things are now going RIFC's way - paid back Ashley, two big court cases won, funding to get them through to the end of the season provided - is the drama series coming to an end now?
Big Bad Mike's no gonnae be chuffed with this. He'll be sitting somewhere stroking his cat, and planning all sorts of retaliation. Lost a battle, but methinks the war is just going to start now.
Court adjourns until 2.30

Sounds to me like the judge came in today thinking, why am I wasting my time on this nonsense & acted accordingly. Some of his comments took me back to the Jeffrey Archer fiasco when the esteemed judge asked, " look at his wife, is she not fragrant"! Having said that I don't understand why SD did not have King giving evidence.
Since the ref was so scathing about SD's application, isn't there a chance that the Huns will get awarded their costs from Ashley? In that case they'd still have their £300,000, which they could use to plunder other Scottish clubs' best talent, and all would be well.
Court will be sitting this afternoon to discuss terms of injunction Sports Direct have against RIFC

Both parties to discuss the matter of the injunction just now. That may be heard briefly in court tomorrow with a view to hearing in January

Ashley has to pay 400k for today! Its madness.
It seems to me the judge was taking the view that the case was brought by Sports Direct at the behest of Ashley in order to hand out a personal kicking to King to teach him a lesson not to mess with Mike Ashley, rather than because Sports Direct in reality thought, or even cared, that what King had said had actually damaged the company or even Ashley at all.
If there's one thing the courts hate its folk wasting their time, especially folk who are clearly using them to settle personal grudges under the guise of another matter. They also take a dim view of and treat with disdain a lawyer with a badly prepared case, which looks like what's happening here.
Ashley is gonna come out of this looking like a fool. Heads are gonna roll and if it was personal before its gonna be a hell of a lot more personal now.
But did God smile on the most righteous today? One's as bad as the other. I don't think the SD silk had time to tie his gloves before the honourable judge started putting in a few sharp jabs before landing the knockout punch. :take that
The next Phil and JJ blogs will be interesting.
Judge was particularly scathing that counsel for Sports Direct brought no evidence to court proving King made the statements reported

Hope you found that tweeting useful. Court will probably sit again at half 2 to briefly sort out future matter of injunction.

Another revelation from court was that Rangers repaid Sports Direct their £5m loan yesterday.
Sent from my iPhone using Tapatalk
To summarise 3 reasons Sports Direct lost in court today.
1. Dave King mentioned only existence of meeting with Ashley not content
1/3
Sent from my iPhone using Tapatalk
2. No evidence was presented to show beyond a reasonable doubt King made statements attributed to him
2/3
Sent from my iPhone using Tapatalk
3. King was not called as a witness so his testimony is his affadavit was not able to be challenged.

MA appears to be taking a serious beating, the bigots well ahead on points :(
King: "It was an absolutely humiliating defeat for Mike Ashley. I'm delighted with the outcome."
Sent from my iPhone using Tapatalk
King: "I've never witnessed a strong judge really virtually tearing someone apart the way he did today."
Sent from my iPhone using Tapatalk
Eh? £300K taken out of the New Huns' January budget. What's not to like?
A bizarre argument for anybody non-Hunnish to make, but especially a Hibby.* Are you seriously making a Regan/Doncaster "Scottish football needs a strong Rangers" argument?
* For the avoidance of doubt, not casting aspersions on 0666's Hibby credentials which are much stronger than mine, even if he is a Hun apologist.
Great work.
From reports, no surprise judge found in King's favour.
There is information in the public domain about Rangers Retail that SD surely don't want out there. Why did they not go for that?
I do agree that putting someone in prison for acknowledging a meeting or just saying they want to renegotiate a contract is ludicrous.
I think the % split and ownership of brand names and security came out at the time the loan was made. How about the 7 yr termination clause? Who leaked that?
Can't say Ashley didn't deserve today if he didn't even inform his own lawyer Sevco had repaid the £5m loan yesterday.

Personally and from the tweets passed on by Ozzy, cheers bud, :)
Have to say the Judge was correct! Jail someone for nothing? Nah don't think so!! Also, was quite clear how King got his glib and shameless liar attributes: plays the game well, creates ambiguity and uses ignorance as a defence! Worked this time but in future .... the very very near future?
It's like two bald men fighting over a comb when these two claim the moral high ground.
Court called back into session to deal with press reports. Judge says he unhappy with Daily Record article, counsel agrees is "inaccurate"

Judge says he gives Daily Record "nil points" for accuracy of report
Sent from my iPhone using Tapatalk
Judge says that just because he has dismissed commital does not mean he has 'acquitted' King
Sent from my iPhone using Tapatalk
Judge says he would advise Mr King to say nothing to the press until he hands down his full judgment
Sent from my iPhone using Tapatalk
Judge asks if the Daily Record has a reporter in court? Is told they do not.

Court adjourns again until 10am tomorrow.

Dave King has been cleared on accusation of contempt. Whether he breached the "gagging order" is a matter which may come to trial in January
Sent from my iPhone using Tapatalk
Judge ended session by saying that it was a bit premature to report "Mr King has been vindicated"
Sent from my iPhone using Tapatalk
@stgriswalds Not committed to prison but not yet cleared of breaching confidentiality order.
We'll know more tomorrow

JJ is a windbag.
Mixed day for Phil Macgiollabhain. On one hand, it appears to be his story about the meeting that was the subject of today, so he must have got that correct, however, his story about Ashley tricking him into attending a meeting so that they could serve him with papers as he got of the train in Glasgow was shown to be nonsense. The SD lawyers admitted it was delivered to his address.

So to sum up a, rather chaotic, day in court. Judge has rejected motion to jail Dave King but has not ruled if he breached injunction or not

I just CANNOT believe the 'Rtard' sent no-one to stand beside their man, to support him in his time of need , to put an arm around him reassuring him that no matter what happened today, they would ALWAYS love and support him ??
Wonder what the judge will think when tomorrow's edition carries a full, word-for-word report of everything that happened today ?? (Another 'Exclusive' ??)
It's great if you want to take a very short-term parochial view. We need to be clear that the guy is a bit psycho, and his objectives are not clear to anyone probably including himself.
So where is it going to end and how much is he going to cost Scottish football by the time he gets bored and toddles off to his next victim?
So, to be clear, you think that Scottish football as a whole benefits from a trickledown from a strong Rangers?
I think that's only a very slightly longer term view. If the New Huns are crippled it will also weaken Celtc giving a vacuum at the top of the game that will be filled by someone that could be us. Plus, you surely don't want to condemn Hibs to another season in the championship as some kind of sacrifice for the dubious benefit of having a New Huns that have the financial clout to break up any team that shows a bit of promise?
Surely it's perfectly reasonable to hold Rangers and Mike Ashley in contempt. One, a stupid football club run by a liar which specialised in running up ludicrous debts & has a ridiculous sense of entitlement. The other an arrogant billionaire who built a business on exploitative business practises.
I'm failing to see a good guy in this particular fight.
Given the financial situation that Rangers find themselves in, which they have caused, is it any wonder that investors aren't keen to pay into them?
As for today's stuff, they may not be paying for it. That's still to be decided.

From a Hibs point of view you want to see Ashley inflict as much damage as possible, for as long as possible on Rangers.
I can't pretend that I didn't love seeing Ashley get the push ripped out of him today.
It's good because there will be losers but not necessarily winners.
Confused about the 5m.loan. Ashley's lawyer didn't know about the repayment? And no announcement from RIFC?
Are we sure it happened? :)

He'll just get madder and madder. The guy's as psychotic as King is a liar. Unlike the penniless King, Ashley's obviously got the cash to play the long game.
Seriously, I've had a close up of Ashley's psyche for nearly nine years now. Not a chance in hell this is even close to over.
Don't bet against 'Sports Direct.com' as the next shirt sponsor of the hun.
Shark officially jumped with not a hint of irony.
