Two applications to be heard tomorrow at 10am. Not clear yet what they specifically refer to.

Lifted from Kerrydale Street, while they were discussing the character of the judge. :

Has anyone Googled 'Judge Peter Smith'?

Reprimands, rants, etc. Seems handpicked for a Dave King circus.

    http://www.dailymail.co.uk/news/arti...t-luggage.html

    http://www.newlawjournal.co.uk/nlj/c...udge-keeps-job

    Quote:

A judge whose behaviour was adjudged by the Court of Appeal as “wholly inappropriate” when he took part in “extraordinary” exchanges in court, has received an official reprimand. Mr Justice Peter Smith was reported to the Office for Judicial Complaints after showing “undoubted animosity” towards a party in a case before him. The furore arose after a case involving Addleshaw Goddard came before him and he was asked to stand down since the law firm had previously rejected him for a job. The judge, however, refused. Sir Anthony Clarke, Master of the Rolls, and two other appeal judges in Howell & Others v Lees Millais & Others, ruled that Peter Smith J had got “carried away”, had shown “undoubted animosity” and was “intemperate” in the way he handled the application for him to stand down. The judge, the appeal court ruled, should have recused himself.

Legal fees incurred by the huns in defending this tripe.
Primarily it affects RIFC and in the very loosest terms Scottish football.

Seems as if things are now going RIFC's way - paid back Ashley, two big court cases won, funding to get them through to the end of the season provided - is the drama series coming to an end now?

Big Bad Mike's no gonnae be chuffed with this. He'll be sitting somewhere stroking his cat, and planning all sorts of retaliation. Lost a battle, but methinks the war is just going to start now.

Sounds to me like the judge came in today thinking, why am I wasting my time on this nonsense & acted accordingly. Some of his comments took me back to the Jeffrey Archer fiasco when the esteemed judge asked, " look at his wife, is she not fragrant"! Having said that I don't understand why SD did not have King giving evidence.

Since the ref was so scathing about SD's application, isn't there a chance that the Huns will get awarded their costs from Ashley? In that case they'd still have their £300,000, which they could use to plunder other Scottish clubs' best talent, and all would be well.

Both parties to discuss the matter of the injunction just now. That may be heard briefly in court tomorrow with a view to hearing in January

Seen a tweet that reckons he was sold a dodgy set of golf clubs from Sports Direct. LOL.

It seems to me the judge was taking the view that the case was brought by Sports Direct at the behest of Ashley in order to hand out a personal kicking to King to teach him a lesson not to mess with Mike Ashley, rather than because Sports Direct in reality thought, or even cared, that what King had said had actually damaged the company or even Ashley at all.

If there's one thing the courts hate its folk wasting their time, especially folk who are clearly using them to settle personal grudges under the guise of another matter. They also take a dim view of and treat with disdain a lawyer with a badly prepared case, which looks like what's happening here.

Ashley is gonna come out of this looking like a fool. Heads are gonna roll and if it was personal before its gonna be a hell of a lot more personal now.

Indeed. If a fair-minded,non-zoomer analysis is sought then that is the last place you'd go to.

SD did not prove the case today. Judge called it right.

Yep all the makings of the rumble in the jungle. Just throw them some boxing gloves and get it over with.
But did God smile on the most righteous today? One's as bad as the other. I don't think the SD silk had time to tie his gloves before the honourable judge started putting in a few sharp jabs before landing the knockout punch.

Judge was particularly scathing that counsel for Sports Direct brought no evidence to court proving King made the statements reported

To summarise 3 reasons Sports Direct lost in court today.

    1. Dave King mentioned only existence of meeting with Ashley not content
