    I did read the statement and it clearly says they have not come to an agreement with their players. If they have not come to any agreement then they can furlough them but they still have to make sure they are paid in full. Anything else is a breach of their playing contract.

    Is that right? Surely if a company has no money and furlough staff, they have no obligation to pay anything more under the circumstances. That’s my take on it.

    Not obligated to. But employees also need to agree to be furloughed, unless there is anything in your contract that allows it. If you refuse it might result in redundancy. But you still need to agree to it.

    That is the case for normal employees. If Hearts do that to footballers though they will be breaching football contracts which is against the laws of the game. Fifa rules also ensure that clubs cannot break players contracts. They would be looking at points deductions, fines and transfer embargo’s. And at the end of it all they would still need to pay the players.

    Unless Liam Boyce agrees to it, Hearts still have to pay him his £6k a week. They can claim back £2500 a month but they still need to give Boyce his £26k.

    Someone will probably tell me I’m wrong in a minute right enough, just speaking from my own experience. I think a lot of it comes down to the what is stated in your contract, irrespective of your occupation.

    And nowhere does the statement say that the players will be receiving full pay - which is what you said. They paid their players in full for March. What they’re “negotiating” is the most they will be able to screw out of each individual. No player there will be getting their full wage for this month. It will be interesting to see what her next statement says once the negotiations have concluded. At least she hasn’t disclosed any timeframe this time around.

    So as an employer myself. You pay your furloughed staff member 80% of their wage or 100% if you so wish.

    The government gives you back 80%. You actually have to pay the salary for the month though then the government is paying you back at the end of April.

    The question is, do hearts have the money to pay the wages until April?
    But the Govt 80% contribution is capped at 2.5k. Whatever you want to pay over and above that - if anything - is at your discretion.

    So they have actually tried to get players to take a 50% pay cut, until the Government announced the Job Retention Scheme.

    After that, they tried to get them to take a 30% pay cut (presumably only because the players had already refused the 50% cut).


    The devil is in the details

    I think the detail is that that for players who were on £5k+ per week, Hearts might only have been able to afford to pay them £2.5k per week, but now the government are fronting £2500/month that reduction in salary drops from the 50% requested initially to now become 50%+£2500/month.

    Unless a player agrees to take less then they will be getting their full pay.

    Yep.

    Rod McKenzie for his own reasons got it severely wrong upon advising Hearts in particular that they could use a vague clause to rip up player contracts.

    Deliberate or just mistaken? Who knows?

    Thankfully, most of the players knew Hearts were just at it. Attempting to fake news perfectly legal contracts.

    Rod McKenzie was virtually allowing clubs to carte blance rip up player contracts who they wished they hadn't signed. Hearts in particular. Football anarchy. Thankfully the players stood frim.

    Rod McKenzie was giving a legal opinion, nothing more. Personally I think a court would throw it out.....

    Can we just clarify now that we dont need to hear "i dont care..theres more important things right now" when Hearts are confirmed as relegated. Yes there is more important things but that does not mean we cannot have a serious laugh at them going down. Their support in general are arrogant, deluded thickos and deserve nothing less than trips to Alloa and Arbroath in freezing cold January. I hope they stay down there for years.

    Well I’m certainly not the sort to gloat at my neighbors sad demise, but assuming, in some parallel universe there was a version of me with fewer scruples, I’m almost certain he’d be speculating that the FOH donations from the fans must be massively drying up by now.

    Would love to see the numbers on these now.

    That’s a very good point that I hadn’t considered, do you know how much were they getting previously per month from FOH?

    Hearts have previous for this - Benny Factor could have stepped in and paid off the charities and other creditors that they stiffed with their last administration but held off until afterwards.

    Hearts haven’t furloughed their players yet. According to the latest statement she claims they are planning to do that and that negotiations are ongoing.

    Let’s not forget the digs she’s having at us in there. Mentioning clubs with wealthy owners and basically saying the FOH model restricts their ability to invest.

    She truly is clueless and has wasted £30 million in the last 5 years. What a calamity.
