It's the Court that appoints an administrator, but the petitioning creditor/board normally puts forward a nominee - he can then be ratified or rejected at a subsequent meeting of creditors, so UBIG would have some say in the appointment, but Ukio would not as their debt is secured and sits above the normal conduct of administration.
The assets are fully covered by a security, so the administrator has limited control over them - Ukio's administrator still holds all the cards there, and yes, they could call their debt in by forcing the sale of the assets on the open market. They could also theoretically retain the full debt through administration so that it would still be due if/when HoMFC came out the other end.

The club are supposed to declare if they haven't paid. If they don't, the SPL (as they are watching) are entitled to ask the question. If they don't believe the answer they are given, they will be entitled to ask for proof.Last edited by CropleyWasGod; 11-06-2013 at 09:07 AM.

There`s been a lot of talk about UBIGs assets being frozen and that Hearts cant be sold because of this.
A question. Could Hearts be " unfrozen ", thereby allowing them to be sold if everyone round the table agreed ( administrators, Lith authorities and whoever else )? Or is this not possible if we assume that they remain part of an ongoing investigation into Romanovs nefarious activities? Are they even part of this investigation?
I know that`s actually 3 questions but i`m trying to get a handle on this as there seems to be mounting speculation that it may possible for them to be sold on......if all parties agree.

A couple of things;
1. I'm with Cav in being utterly confused by this repayment plan. My memory was it was agreed 3 payments of approx £0.5mm each over next 2 years. I queried this on here recently & Sergey (I think) kindly directed me to a/c's & AGM details which stated monthly payments over 3 years.
2. Now here's the good news. Rule A6.24.3 (I think) states any default on a repayment plan must be reported to the SPL Secretary within 2 days of the default occurring. IMO that default has already occurred & if Yams have not reported it then they're in breach. Even accepting an argument that default will occur today they will have to report by Thursday. I believe the sanction is a return to the signing ban, anyone fancy Danny Wilson? The main point however is that SPL are involved again & don't need to wait before taking action.
