If the creditor of UKIO decide to reject the CVA / bring about Liquidation leading to the sale of PBS then you would presume that the £2.5M which I s already on the table would be bid by Bidco. You would then also see if a developer, maybe hiding behind a faceless tax haven based company, would make a higher offer. It’s believed the gathering has resulted in a fresh delay of up to 10 days, with a lack of some technical details thought to be the cause of the postponement. This is understood to have baffled administrator Bryan Jackson, who was confident he had passed on all the necessary details for the £2.5million CVA deal to pass its next step.
And the lack of contact from Lithuania following repeated attempts by BDO and lawyers is likely to be viewed as a bad sign.Ukio Bankas held a charge over Tynecastle as security on around £15.5m of debt owed by Hearts, but it had been hoped the CVA agreement with the bank’s administrators, Valnetas UAB, in November would be passed to allow the transfer for their near 29 per cent shareholding and the ground to Ann Budge’s BIDCO.
Any delay, with UBIG not now due to meet to clarify its position until April 7, with a further 20-day period set aside for appeal, could prove fatal for Hearts as BDO struggle to maintain cash-flow.
