The big problem that he has is that by saying the amount of votes he needs (what he lost by plus one) it'll be difficult to argue that he wanted a fair recount as opposed to just the right amount of "votes" to be found. Hard to imagine after the last few years but of the Senate can somehow recover some of its bi-partisanship they might actually be able to craft some legislation that they can agree on.
