I thought the 14 weeks was quite strict, but the 10 year ban quite lenient.

Does anyone know the likely sentence if that kind of assault happened on the street? (Just out of interest)

In Scotland, if it's a first offence, possibly no jail time. The accused could be asked to give the victim some reparation, they could get community service, a fine or a combination of those things.

There’s a huge difference between the criminal justice systems in Scotland and England.

Trials with and without a jury, the number of members in a jury and evidential requirements.

And no, I’m not a lawyer, but I worked for several years in law enforcement.

Didn’t seem the type to have got the grades - on the bright side technically the best chippy is in Anstruther.

Depends how old the lad is, if he is under 21 he will have sentence deferred by judge for social work reports.

In Scotland it will be an automatic social work report if the offender is under 21 but also if they are facing a first custodial sentence or if they are facing a community service order or probation. The sheriff can order a social work report regardless of that if they think it is appropriate.

Did anyone catch the phone in on Radio Scotland this morning? It was regards crowd trouble at football and whether Friday night and the Brum derby events would put you off attending matches.

Only cought a wee bit of it but I did hear Alan Preston tell of a guy he knows who got a banning order last season has been able to attend every game this season just by growing a beard over the summer to change his appearance!

I've always thought these banning orders weren't worth the paper they were written on.

I note the guy from Friday has pled guilty to Breach of the Peace.
The interesting thing about the guy is he has no previous convictions.
I know we are all annoyed at the guy but all things considered he shouldn't go to jail.
I note lots of abusive posts from Rangers fans on his facebook account.
Stupid laddy has messed up bigtime.
A shame for his family if they get dragged into this.

I agree.

I would think around a five hundred pound fine would suffice with an indefinite ban from ER handed down from the club.

He's a young lad with no previous convictions who had a rush of blood to the head and committed an idiotic act.

Probably had a long weekend in St Leonards with his family worried sick.

Hope thats the outcome anyway.

Should be no more than a fine and ban from ER, but courts might take a dimmer view given he could quite easily have caused a full scale riot. There are plenty of headbangers in the Sevco support who could have taken exception to someone attacking their team captain. It's the danger actions like this brings to others including kids that's a real problem.

I think the fact it was tried in Magistrates rather than Crown Court was also why it was able to go through the courts so quickly. Had he pleaded not guilty then it would have been deferred to the Crown Court and would have taken a lot longer (I think).
