I imagine no-one else here will find this interesting, but after receiving an unsolicited email advertisement from this firm today, I was surprised that the Scottish Law Society has more lax regulations on publicity than the English SRA.

I found it strange to receive the email as I don’t necessarily remember allowing such communications.

I imagine no-one else here will find this interesting, but after receiving an unsolicited email advertisement from this firm today, I was surprised that the Scottish Law Society has more lax regulations on publicity than the English SRA.

Maybe one for The Holy Ground, but I'm sad enough to find it interesting!

The Law Society of Scotland doesn't have a specific rule on this because solicitors in Scotland are bound by regulations prohibiting direct e-mail marketing to individuals (rather than, for example, companies) in circumstances where the recipient has not given consent to receive such material (and is not an existing client of the solicitor's firm).

The email was from the club - they send on behalf of club partners so there is no access to or transfer of data. Similar to the likes of Marathonbet, Eden Mill etc.

Says it at the bottom of the email:

You have received this email from Hibernian FC on behalf of Watermans Legal because you are subscribed to our 3rd Party mailing list.

Then gives you the option to change your preferences or unsubscribe from the list.

Personally have no issues with it as it benefits the club. The more people they have that they can reach with marketing and communications like this means the more they can charge for sponsorships and partnerships.

That's where the fabled 400,000 hearts fans came from, a marketing pitch from them to justify the cost of sponsoring or partnering with them.

I wasn't raising a point about data or spam emails from the club's sponsors in general. It was a solicitors regulation point. From my quick reading of the Law Society of Scotland's rules, it doesn't matter if the club or the firm of solicitors is sending the email.

Sorry, I was referring to EU regulations. I don't have access to them right now but I think they're called something like "Privacy and Communications".

Interestingly (liberal use of that term), until relatively recently, solicitors banned themselves from advertising and it was actually the Government which essentially forced the profession to remove the ban.
