View Full Version : NHC a company still afloat, yet in debt to many other companies

I was wondering about companies who have floundered on the rocks ,yet came back from the brink, to stay afloat yet they have yet to pay hundreds of small to medium companies that they have not paid. what sort of rules exist in the modern age, when a company....say, a football club , were millions in debt, and yet they came back from the brink yet retained the name of the company? we all know, or have heard of phoenix companies, owned by some chancer with a big house in, let's say Barnton, who lets his company go under and starts up on the Monday, with another name but still gets work or business fitting double glazing, an advertising agency, selling houses etc etc. the real point is, why can any company, operate in the same business they were in when they were in administration, retain the same business name and operate under the exact same type of business with the same governing body rules for that business, without paying back all the money that they owe(d) before administration? Is this a Scottish thing? do they actually get off, "scot free". ?

Our insolvency laws aren't perfect, by any means. They can be extremely frustrating, but so far nobody has been able to come up anything better.
