Looking for some advise please
Sold something on ebay, buyer has paid via paypal and I have posted the item
Buyer has now contacted me saying he will send it back and wants a full refund as he has bought a different model in the shop
Should I refund or tell him to do one?

Tell him you don't want it back. Tell him if he doesn't want it then he should stick it on ebay. (Provided what you sold him was what you claimed you were selling!)

I reckon he has 7 days from receipt to tell you that he wants to return it, under the Distance Selling Regulations (I might be wrong) although some stuff is exempt (CDs, perishables etc). If it's over 7 days, it's probably up to you.
He can open a dispute with eBay though and, if you care about your reputation, it might be worthwhile just taking it back and reselling it.
eBay will have all the proper details about buyer / seller rights etc on their site.

Did you offer a returns policy on the item in the description of the item?
If not, and if it works ok and is not faulty then tell him to go take a jump!
Your not a shop, it's a private sale so unless the item is faulty or you have offered a returns policy you don't have to do anything, although he may choose to leave you bad feedback.

:agree:
I would go with what bighairy says above.
He probably got carried away with himself and paid more than he wanted to for your item and has seen it somewhere else cheaper or maybe even was bidding on a similar item on Ebay. I would be telling him to bolt.

I would tell him you are happy to refund(sale price, not postage costs) if it is sent back in the same condition. I would also insist it is sent recorded delivery as you cannot be held responsible for any loss in the post.
It wouldn't be worth the negative feedback to say no, and my experience of paypal claims is that they always shaft the seller in favour of the buyer. e.g. I had a proof of postage receipt for an item that was "lost" but they favoured the buyer.

Sorry, but why should Stewboy refund? There is nothing wrong with the item that was sent to the buyer, he has clearly just changed his mind. No way would paypal come out in favour of the buyer in this one and negative feedback can always be commented on.

To be honest, I don't think you need to refund him. It's actually quite difficult to leave negative feedback, as Ebay always tries to resolve the problem first. I mean, really, what's he going to say, "Seller refused to take item back and refund my money when I went out about bought another model". Hardly reasonable is it?
There is a page about returns, although I'm not sure if it only applies to businesses (http://pages.ebay.co.uk/businesscentre/law-policies/returns.html) and it says at the bottom, "Please note that, under the Sale of Goods Act 1979 (as amended), there's no legal requirement for you to provide a refund if the buyer simply changes their mind."

He can do what he likes but personally I would refund because it isn't worth the negative feedback. Even if negative feedback is commented on it raises doubts and it would stop some people bidding.
As for there being no way that paypal would be in favour of the buyer, I wouldn't expect so but I can only speak from my experience. Why would they rule in favour of the buyer when I had a proof of postage receipt to prove I had sent the item while they only had the word of the buyer to say it hadn't arrived?
They shaft sellers because they can. Buyers have the option to make their purchase elsewhere but sellers don't have much choice, they have to use paypal.
P.S. I know you technically don't have to use paypal but nobody would trust a money transfer and cheques would take forever.

When i sell stuff on Ebay i make sure that the listing always says :
Return policy
The seller will not accept returns for this item.
This way no matter what they decide you are covered as far as eBay are concerned, the buy bought the item knowing that you will not issue a refund under any circumstances.
