This man really is a sick, sick individual, has he not put this girls family through enough? My four year old son could have told you he was guilty of murdering her! :brickwall
The man found guilty of raping and murdering Falkirk schoolgirl Vicky Hamilton is to appeal against his conviction, it has emerged.
Peter Tobin, 62, was jailed for life and ordered to serve a minimum of 30 years following a four-week trial at the High Court in Dundee.
He is also serving life for raping and murdering Polish student Angelika Kluk.
Tobin has lodged a notice with court officials stating that he intends to challenge the guilty verdict.
He is also seeking to overturn the judge's sentence, which is one of the highest ever imposed in Scotland.
His defence team is not required to state the exact grounds of the appeal until a later date.
'Horrific acts'
Vicky was last seen in the West Lothian town of Bathgate after visiting her sister Sharon in Livingston on 10 February, 1991.
Her mutilated remains were unearthed from a garden in Margate, in Kent, where Tobin also lived for a time in 1991.
During the investigation into the death of Angelika Kluk in September 2006, it emerged that Tobin had lived at 11 Robertson Avenue in Bathgate when Vicky went missing.
A subsequent search by police uncovered a knife in the property which had traces of Vicky's skin on it.
The High Court in Dundee heard that it was at this address that he drugged, raped and murdered the schoolgirl before cutting her body in two. When sentencing him, trial judge Lord Emslie said: "Abducting and killing a child on her way home from a happy weekend with her sister and then desecrating her body must rank among the most evil and horrific acts that any human being could commit."

It's all a game to attention seeking **** like Tobin. This has the potential to upset the family, and will no doubt cost a lot, but the main thing is that he will spend the rest of his worthless life in jail.

That's what annoys me most about this whole thing, he's going to do that even if by some amazing miscarraige of justice means his appeal is successful, he should just admit his guilt and give Vicky's family some closure on the whole thing.

This guy is a burden to society in jail and should just be killed now.

I said it on the thread about the father that raped his own daughters for years and the same goes for Peter Tobin. I do not agree with capital punishment and I hope it's not brought back. However, if it was, I really would not shed a single tear if people like him were executed.

I always suspected he would appeal. The actual physical evidence is quite ropey and there's a lot of circumstantial in there.
If we never knew about Tobins history he would probably never have been convicted...and how can he be found guilty of rape when there is no physical evidence?
There's no doubting he commited these acts due to his nature and past covictions but he has no doubt been made aware of his right to appeal.
I'm just hoping another form of "justice" is allowed to take it's course while he is inside. It might not solve anything but it might make him understand some of the pain he put his numerous victims through.

My understanding from the press reporting includes:
- a knife with Vicky's skin on it was found in his former house in Bathgate
- her body was found buried in his former house in Kent
- he was seen by a neighbour digging her grave
- his DNA was found such as to indicate sex
- his fingerprints were found on the bin bags in which Vicky's body was buried
- his infant son's DNA was found on Vicky's purse which was found in Edinburgh soon after her disappearance
There is a compelling amount of circumstantial evidence, and the physical / forensic evidence is tantamount to a smoking gun. Cases don't get much more "open and shut" than this.

If Tobin had been executed for the Angelina murder, chances are the Hamilton case wouldn;t have been solved, and the family wouldn't have got closure.

Surely all the evidence on the Hamilton case that points towards Tobin would do so whether he was alive or dead?

But it would be evidence that couldn't be tested in Court. Can't try a man once he's dead. All the family would have would be police opinion.

Going by the appeal I’m guessing he has denied the allegations, and therefore don’t really have any more closure than they would have if all they had a was a lot of evidence pointing towards Tobin. :dunno:
