Someone I know has had money taken from his bank account over a number of months. Has anyone had the same done to them and what was the banks attitude about this e.g was it refunded????

If it was fraud the banks are obligated to return this as soon as the fraud is established, my mate had money taken out from gibraltar 3 times, taking him over his o/d limit, bank said it would take 6 weeks to return his money, one phone call from me telling them I was reporting them to their ombusman and his money was returned in a week, banks are chancing barstewards.

That is what I thought however I think there is a definition about the account holder having taking reasonable measures to protect their account details. I'd imagine that banks will become more sticky about this sort of thing the more it increases in nature.

Under the DPA they shouldn't have spoken to you.

Aye but they thought I was my mate, he's no very confident on the phone, where I am. So a wee bit fraud by myself but I hold a special place of hate for banks, he was sitting beside me at the time, shhh dinae tell the polis :wink:

Not sure but i dont think banks need to refund you all the money?
It is your responsibility afterall.

I know a guy that this happened too, but he had a decent credit card which covered this kind of thing. He got all his back. They did tell him it would take 4 weeks. He complained and said he could not live without it for that long and they gave him it back the next day.
They just try to keep it so it grows intrest!

It would depend entirely on the circumstances Jim. If it was clearly fraud then most banks would refund after an initial investigation, however if the account holder had not taken reasonable steps to prevent the fraud or had acted neglegently, or had agreed payment only to later change their mind then it's a different matter.

Yep that is what I thought will depend on circumstances.

Depends if it is fraud or not? Can the bank identify where the funds went to? If it has been the bank who have removed the funds to perhaps cover arrears on another product, then you've no chance. If it is fraud, then the bank should cover the full amount (as per the banking code).

There were no arrears on another product, the money has been apparently taken using another card however the bank havent been the most helpful in informing where these additional payments went.
