I've just been told by a Jambo mate who has contacts at Tynie, that their manager never received his salary at the end of October.

He (my mate) is extremely worried.

I fully expect Kickback to react like this

Yam One: "Good. Don't like Paulo anyway, so maybe he'll just leave"

Yam Two: "Yeah I agree gud wun Vald!1!!"

Yam Three: "I say, doesn't anybody else think this is actually bad news?"

Yam One: "Get lost Hobo, only Hobos say bad things about Mister Romanov"

Yam Two: *inserted unfunny animated GIF*

Her Majestys Revenue & Customs. Aren't hearts owned by a Lithuanian? Won't apply to them then this paying tax/VAT caper. Paying anything in fact.

On it's own it'll probably amount to nothing. However, Hearts fans should be concerned with the regularity of their court appearances recently and with their players still not being paid alarm bells should really be ringing. 2 weeks isn't a BACS hiccup - I've had a BACS hiccup once. It was sorted in 24 hours.

Of course, I say Hearts fans should be worried but they're not. Everything's A-OK in la-la land.

It's been suggested on here before that Hearts are on a rigid repayment schedule with HMRC, and that missing a payment would spell doom.

Given that they haven't paid their players now since September, what are the chances they missed their October installment so now the taxman has broken out his collection of large, pointy knives...

Even when the wrecking balls are demolishing the Theatre of Asbestos, you'll still have a midden of Jambos logging onto FJKB and declaring either a) their undying love for "Mr Romanov" or b) that this is how big clubs operate. Most likely both.

It actually angers me, possibly more than amuses me, how so many supporters (400,000 apparently) can bend over and so willingly accept the decisions from this man. Not only do they do nothing, they defend him.

It's like a drunken husband smashing the bejaysus out of his wife only for her to say "oh it was just an accident, Saulius is not really like that". The lengths and breadths they will go to defend him is ****ing unreal. Staggering.

Wallace Mercer tried to strike a deal to take ownership of the Hearts ticket office, yes, just the ticket office and he was derided by all of a bloodied-turd persuasion, Chris Robinson tried to make one minor adjustment to their badge and was almost lynched..........Vladimir Romanov bought and sold the soul and integrity of an entire club and yet still they applaud him.

We warned you, Jambos, we f******g warned you and you were all too busy burying your plukey heids in the sand to listen. Well, away upstairs and brush yer teeth 'cos the Pyjama Man's gonna tuck you into bed in a short while.

Laugh? F******g laugh? I'll almost pay the players wages.

If a party has defaulted on a payment plan has been default on then a motion would be the procedure to bring this to the court's attention and seek what further order the Petitioner i.e. possibly the Advocate General, who acts for and on behalf of Her Majesty's Revenue & Customs in Scotland, so desires.

Failing to adhere to the payment plan would constitute failing to pay debts as they fall due I would imagine. A provisional liquidator could be the next step if it's felt that assets could dissipate.

"Entrepreneurs and various large businesses turned their backs on that sort of football and left this national heritage to the mercy of its own fate.

That sort of outrage from the media, federation and tax authorities kills everyone who is trying to change this situation including ourselves who are ready to invest in Scotland once again with stadium plans. And no one is interested in what's going on.

This is why I think that there is no point is spending millions to watch someone else's show."

Hang on a minute - just checked the court page again and the motion is "unstarred" - which means it goes through on the nod i.e. HMFC hasn't sought to oppose it. There will be no hearing tomorrow.

It may be that whatever the motion is for has been agreed between HMRC and HMFC's lawyers and thus is likely to be of a procedural matter - if HMFC wasn't happy with whatever the motion is for it could have opposed it. And surely even they would seek to oppose their own winding up.

Wallace Mercer retained ownership of the ticket office/shop/administration building when he sold Hearts to Robinson/Deans. His widow sold it to a Lithuanian registered vladcompany shortly after his death.

We're all aware that if Hearts are pumped into administration or reform under a different name then they automatically lose any claims on their history as Heart of Midlothian Football Club and thus, have no trophies or honours of which to speak of? Yeah? Cool.

Bit of a stinker to consign the 0v7 to history but their Scottish Cups and league titles go down into Room 101 with it.

(http://www.bbc.co.uk/news/uk-scotland-edinburgh-east-fife-15566905)A motion has been lodged at the Court of Session to wind-up Hearts football club. (http://www.bbc.co.uk/news/uk-scotland-edinburgh-east-fife-15566905)
The petition against Edinburgh-based Heart of Midlothian Plc will be heard on Thursday. (http://www.bbc.co.uk/news/uk-scotland-edinburgh-east-fife-15566905)
BBC Scotland understands that it is over a tax bill due to HMRC that may have already been paid. (http://www.bbc.co.uk/news/uk-scotland-edinburgh-east-fife-15566905)
The club had similar winding up orders served against it in 2009 and November 2010 over unpaid tax to HMRC. Both were settled after the club paid the bills.

So what does a winding up order entail exactly?

Will they basically be shut down and the assets sold off to recoup what can be gotten?

If this is a genuine winding-up order, and it is not being opposed, then I guess the court appoints a receiver to wind up the affairs of the company.

What is the motion for exactly?

Don't know, the court website doesn't show them. Either the BBC aren't entirely accurate in what they're reporting - if they haven't had sight of the court process at Parliament House then they should be reporting that "a motion has been lodged at the Court of Session in relation to a winding up petition in respect of Hearts football club." rather than "a motion has been lodged at the Court of Session to wind-up Hearts football club."

The motion could be for a whole number of things and, as I have highlighted above, given it isn't opposed I'd be surprised if it's to seek to, say, appoint a provisional liquidator, which would mean the board would have its powers severely restricted.

Winding up order means liquidation. Club would shut and assets liquidated to pay debts. They would lose league membership and cease to exist as a company. Basically if it goes ahead, they are ****ed.

Why would they go ahead with the hearing if it has been settled, seems a waste of money no?

Unless that explains it being unopposed, in that HMRC lodged the petition, Romanov panicked and paid up (hence the players not getting any cash) and tomorrow is the resultant hearing, unopposed as HMRC will turn up, say that all is fine and go home...

There will be no hearing tomorrow - that could only have happened if Hearts had lodged opposition to the motion, probably on Tuesday or Wednesday. What will happen is whatever the motion is for will most likely be granted. The only way it wouldn't would be if the judge wanted some point to be clarified and wished to have parties address him. Unlikely if the motion isn't opposed.

John Barnes The belief is that the petition is for a tax bill due to HMRC. But it's understood Hearts might have already paid it within the last week.

That would make a lot of sense. The motion would likely be for dismissal of the Petition (no doubt with expenses in favour of the taxman) which Hearts would be unlikely to oppose - as they caused the action to be necessary by failing to pay up on time, they would be found liable for the expenses of the procedure.

Tactically if he hadn't paid up and wanted the club to survive he would have sought to oppose the motion though - by doing so he would necessitate a hearing where the club could plead for a stay of execution. I'm not that familiar with the corporate structure of HMFC at present but as far as I know he'd have more to lose than gain if he let them go to the wall right now surely?

HEARTS last night sensationally told their top earners to find new clubs.
Jambos chiefs finally came clean and admitted they want to flog their leading players.

SunSport can reveal that winger David Templeton has already been offered to Rangers for a cut-price £500,000 fee.

Others will go in January as Hearts, owned by Vladimir Romanov desperately try to overcome a crippling cash crisis.

Bosses also warned players they do not know when Romanov will cough up unpaid wages.

The bombshell came at a crisis meeting yesterday after a group of senior stars demanded answers.

Instead they were told to start looking for a move.

Besides Templeton, a string of other players are also sure to attract bids.

Bristol City will be encouraged to step up interest in Ryan Stevenson. Hearts will also accept offers for Ian Black, Andrew Driver, John Sutton and Marius Zaliukas.

The news is also bound to cast doubt on the future of boss Paulo Sergio. It would appear to confirm that Romanov is not prepared to put any more of his money into the club.

There are now real fears about the very existence of the 127-year-old club.

Whilst fans will presumably go the sun yada yada yada I'd imagine agents/union reps/players would be desperate to tell a journalist about this.

Hearts have failed to pay their players' wages on several occasions in the past.
Hearts have even had winding up orders lodged at the courts before.
This "major story" about players having to be sold off on the cheap and questioning the existence of the club is in The Sun newspaper. Personally I would doubt them even if they told me that the sea was blue.

There is nothing happening at the moment that has never happened before. Hearts' future has been cast into doubt on several occasions in the past few years and yet they're still hanging around like a bad smell.

Maybe this time it is more serious and maybe they could be out of business in the very near future but I'll hang back from any premature celebrations for now.

I don't want them to go out of business but I would like to see them demoted to the 3rd division, playing in front of crowds of under 5,000 and being relocated to Livingston.

They've been lording up for years and it's now pay back time.

And second of all, who are we going to talk about on here since 60% of the threads are on Hearts! I actually agree. But they have had it coming for years. They have been snobs of the worst kind. They have told the Scotland they are the third force. Signed players they could not afford. Gupped us regularly and won the Scottish cup. All the time they ran up huge debt. As has been said its a form of cheating. Yes ill miss the Derby games but its time for them to pay the price. 3 division football beckons

At least when it's all over and the bailiffs have closed the doors of Tynecastle for the last time their supporters can reminisce about the great times and relive the day when Christian Nade and Laryea Kingston each scored a hat-trick against Barcelona in the Champions League Cup Final.

All the misery now seems worthwhile.

To have won the war and then singlehandedly tried to change Scottish football for the better, to be treated like this is truly a slap in the face.

In a day and age where capitalism rules and the world teeters on the edge of financial ruin, Hearts have bucked that trend by refusing to renovate their stadium in a "keep up with The Jones's" methadology.

They have tried in vain to give the great city of Edinburgh the gift of a community stadia, where fans can run on the playing arena and embrace opposing managers, where flags uniting all of Great Britain can be waved as a show of peace, love and unity, where players such as Craig Thomson can try and reach out to the younger generation with the full backing of the club, a club that holds back the players wages in order to teach them how to save for a rainy day.

A club that was too forward thinking, too purist in the art of the beautiful game for it's time.

There is only one loser here......... and that's football!

We, the footballing community will mourn these dark days, as we sit back and let it happen, I, for one, will not.

That's what I'm hoping for too. 10 point deduction (which would put them 5 points behind us and right into relegation trouble - if they last that long), sell any players that are actually worth more than 2 bob with all proceeds going to HMRC (gawd bless you ma'am) to be left with a youth team and a few huddies, to take a real skelping that'll make the 7-0 game look close. Maybe Vlad has paid the tax bill so that he cant dismantle Hearts himself, selling any players he can in January and telling the rest to leave so he doesnt have to shell out the wages. If he plans to leave them I would guess he will try and get the wages down as much as possible so he can rake in any gate money, sell any players of worth and pocket that, once thats all done he walks away, lets them go pop and houses are built on tynie. If a winding up order did go through then the players would be sold to pay for the whole tax bill not just this installment so Vlad wouldnt get anything in his pocket.

Nothing to see here. HMRC are dismissing their order and all the cash flow problems are just to do with the end of the Lithuanian tax year (ignoring the fact that the tax year doesn't end until the last day of the year) apparently.

The fact that they've told players to find new clubs is by the by. All big clubs routinely force their best players out by refusing to honour their contracts.

:agree: That suits me too. Rather than a death sentence I prefer that they endure a life sentence with no chance of parole. I want to see them and their fans suffer big time and get humped week in week out by every team they come up against. Having to give up Tynecastle and relocate to Livingston, kicked out of Riccarton because they can't afford the rent, scraping around the worst leagues in the world for 4th rate players and playing in front of crowds lower than us.

If this comes to fruition I will be a very happy chappy.

Maybe they are wanting this tax case not to put hearts under so that they are still trading when the big cases, ie, the one rangers are facing, comes up. If HMRC were to wind hearts up now they wouldnt get any money they are due from the other tax case we believe Hearts will face as will Rangers relating to tax avoidance / evasion.

The more likely answer is that they have indeed paid the installment which is why the players werent paid.

So it appears they've survived. What about Heart's 65m debt which was transferred to Romanov's dodgy bank? Surely he's going to try and claw that back now since he's clearly had enough. That can only mean selling the assets, of which there are only the players and the stadium.

The high earners are off by the sounds of it, so I can only imagine what kind of team they'll be fielding against St Mirren this week. That only leaves that wee patch of dirt off Gorgie Road as an 'asset'.

Today might just be a stay of execution. Personally I don't want to see them disappear, but the idea of Hibs humping them at every derby because they're team is so sh*t is filling me with joy.

Sorry EasyJambo, but I have not wanted to break it to you. I have been hearing noises that Hearts will ultimately be in more trouble than Rangers.

What this means about tomorrow I don’t know, but I expect this to be the second in several steps that only end in insolvency as well.

It is probably good news for Hearts and rangers that both are in trouble at the same time. It is hard to imagine a hardline when so many are in trouble. However, Hearts and Rangers are in by far the most trouble.

Look back on my thoughts on Campbell Ogilvie. It was not a speculative posting."

The Campbell Ogilvie post referred to is here:

It would surely be utter madness for Vlad to let players walk for nothing now over breach of contract when he can have a proper fire sale in January. If he really is walking away now then wouldn't the smart plan be to get as much as possible for players in January followed by recovering anything he can from selling the ground.

The alternative is he takes the mother of all haircuts, cause there sure ain't no white knights galloping along with £35M to spend. :na na:

The £500k tax bill included PAYE this means vlad deducted the cash but never passed it on to the taxman. Then withholds their wages to pay the taxman. You could not make it up. Tick tock

Unless it costs more to pay them than a likely fee would generate...

By the start of January they will be due what, 12 weeks wages including what's owed to them already, with some of them no doubt around the £10k a week mark, that's £120k a player.

How many do Hearts have that would sell for that price in a situation where every club knows that they need to sell and sell fast?

Suspect they try and burn the unsellable, older ones and cling on to Templeton, Driver and the like in the hopes of flogging them. Of course if they keep failing to pay them, presumably they can just wander off if they like anyway...

I’m beginning to see the Mad Ones master plan. :agree:

Don’t pay the wages and payments due to HMRC fall. A significant saving. Well done Vlad :top marks

This is huge news but are people actually over the moon about our rivals going out of business? For starters , I love the Edinburgh derby. And second of all, who are we going to talk about on here since 60% of the threads are on Hearts! Admittedly their delusional attitute is pretty funny but it's never nice to see a professional club go down the tubes, even your greatest rivals.http://www.321pic.com/images/yes-11.png

I am getting confused. Was there a court case today, and is this actually very close to the end for them?

In the BBC report players being hit with bank charges for non payment of direct debts. Come on these guys will be on a minimum of £3k a week thats around £6k a month in take home pay. Its not like this is there first ever pay. Doubt very much if any of the first team are struggling.
